The degree thesis aims at building a legal system for unmarried cohabitation inChina. In addition to the introduction and conclusion, it includes the followingelements:The first section is an overview of unmarried cohabitation. This section can bedivided into four parts in which the author surveys the connotation and denotation ofcohabitation and unmarried cohabitation. By analyzing the relationshipsbetween cohabitation, illegal cohabitation, marriage, void marriages, reversiblemarriages and de facto marriages, the author defines the concept and categories ofunmarried cohabitation, as well as analyzing the existing legislation.The second section offers the necessity and possibility for a legal system in Chinaregarding unmarried cohabitation. The author does a detailed verification onthe reality of establishing such a legal systems for unmarried cohabitation in China..The third section proposes a theoretical foundation for an unmarried cohabitationlegal system in China. It has four parts in which the author reflects upon the existingtheories of unmarried cohabitation, discusses the theoretical foundation that peoplehave the right to choose unmarried cohabitation and proposes to take an extendedfamily theory as the theoretical foundation of the legal system of unmarriedcohabitation. The author expounds the status which the unmarried cohabitation legalsystem has in the civil law system and the profound meaning of establishing the legalsystem of unmarried cohabitation.The fourth section gives specific rules and designs for the construction of a legalsystem for unmarried cohabitation. It is divided into four parts. The author givesproposals for the design of laws and rules in some specific problem cases, suchas establishing and terminating unmarried cohabitation, the personal relation betweenthe unmarried cohabitants, property rights and other judicial relationships betweenunmarried cohabitants.
