Our Work Rental Rights Research

As a way of using works, rental right grew up and formed along with the developing of science and technology and applying of new transmit technologies. For its advantage that buying original or reproductions haven't, rental is well received by most of cultural consumers. In most nations of the world, works rental have the trend of replacing works' purchase, (especially for the rental of phonoitape and videotape)But on the other hand, it also bring about vast shock to the distribution of works and give rise to tremendous losses of authors. Therefore, international treaties on copyright and many countries' civil copyright law have definitely rental right an economic right of obligee.Our country's copyright amendment in 2001 have singled out the rental right which had been included in the distribution right previously and provide that corelational obligee enjoy rental right. But being set for not long, this right is not perfect yet. In the article, the author analyzed the conditions of works rental right in China through investigation and document researching, pointing out the current problems. And also put forward my opinions on queries in library and intelligence service area led to by the set of rental right, to provide some suggestions as reference for the improve and perfect of rentalright law and resolving of relational issues that library and intelligence service have related to in this area,and for our scholars in this discipline to communicate and inquire into further.
