Theory Of Justice Standard Of Value And Ways To Achieve

Justice is the eternal symbol and fundamental value of judicature. As the prerequisite of existence of judicial institution and its supremacy, judicial justice is perpetual topic of judicature and basic principle that we should adhere to in judicial reform. Judicial justice is embodied in substantive justice and procedure justice. But the relation of them is in dispute. There is no common idea about the criteria of judicial justice. There is a great deal of unjustness in present judicature. The realization of judicial justice is hindered by many obstacles, both historical and practical, both internal and external. This essay aims to provide practical resolutions for the problems in present judicature, make breakthrough and innovation in theory, which can be used as reference for the materialization of judicial justice. All these are done after I study the fruits of theoretical research and the experiences of foreign countries. In this essay, I explain the connotation and valuation of judicial justice. Then analyze the components of judicial justice and its internal relations; also summarize the criteria of judicial justice. After analyzing present judicial situation and the reasons of unjustness, I offer my approach to materialize the judicial justice.
