Penalty Limit Theory

Death penalty, also named life penalty or extreme penalty, the most archaic and severest penalty among the penalty system, which is originated from consanguineous Vengeance of barbarism society.As the Chinese government has subscribed The International Convention of Citizen and Political Rights, we should gradually shorten the bridge of the attitudes between the regulations of the domestic law and that of the international Convention according to China realities. Today, while the relationship of death penalty and civil rights has become closer and limitation and abolishment of death penalty has become an international trend, the high death penalty ratio of our country is evident not feasible. According to status quo of death penalty, in this paper, I point out that the abolishment of death penalty is a historical positive trend. However, considering present politics, economics and other situations, it's not suitable to abolish death penalty in our country. So, I suggest that we should limit the application scope of death penalty and put forward relevant measures of that in detail. After doing so, it is expected to bestead to the development of our country's death penalty system and criminal law by studying the restriction of death penalty.
