Study Of Marine Insurance Subrogation Rights

There are various opinions about how to understand the regulations on the Right of Subrogation written in Chinese law. What's more, the CMC, Insurance Law and Maritime Court and Special Procedure Law are far from lawlessness. We need do some work on the subrogation theory, especially on its interpretation, characters, range of power, applicable conditions, time limitation etc.. I think the best way we should start the work is to carry on comprehensive study and research into civil law theory. For example, our law system mainly belongs to the civil law system, but quite a lot of ideas of the common are used for reference for the items on Right of Subrogation in the CMC. If we want to understand the CMC correctly, it is sensible to begin with some theoretical research.This dissertation is based on the theory of subrogation, looks inside those regulations written in Chinese and English laws, and tries to do some research into the Right of Subrogation, with the technique of contrast.There are five chapters in this dissertation, each of which raises some questions, and then tries to give them explanations, and at last introduces the writer's opinion.I hope I can correct some erroneous opinions, and try to do something useful for the improvement of Chinese law.
