Nowdays, the research of ADR have reached a considerably higher level, the research method varied too. Among these method, there is pure theory based on concept logic, there is positive study based on investigation and data analysis too. Different theory system take on obvious conflict and diversiform state. Be effected by foreign theory development, China scholar pay more attention to ADR. Many scholars observe the positive factors and negative factors in the traditional non-government meditation of China, from the concrete evidence. Others seek a kind of ideal institutional design to develop the advantage of ADR from the drawback of ADR in China today. Refer to these above, I try to take advantage of the theory about judicature limits and legal philosophy and legal sociology knowledge to demonstrate the legitimacy of ADR, and the importance of ADR to China's legality construction at the background of China's legality difficulty.
