The article points that the U.S.A takes china as a "non-market economic country" and unceasingly initiates antidumping investigations which led to the determination of high antidumping taxes on numerous Chinese export commodities. The article explains the origin of the question of "non-market economy", discussing the definition of "non-market economic country" in American antidumping law and its standards of judge. Analysis is being made in this article on the standards when the U.S.A chooses subrogate countries, and discussion is also being made in this article on the method for the determination of "normal value" of export goods on "non-market economic country" on three levels. Questions are raised on the reasons for applying the system of subrogate country in international law. The article appraises the regulation of "non-market economic country" in antidumping law, indicating definitely that the system of subrogate country is lack of fairness and rationality, which is the trade discrimination to the so-called non-market economic country. The effective measures are also raised in the article for both government and enterprises to take to answer antidumping investigation initiated by the U.S.A.
