China's Administrative Law "controlling - Balance Of Theoretical Research

The theoretical foundation of administrative law science is to uncover the essence and rule of the administrative law. Within the system of the administrative law science, the theory with fundamental characteristic and status is the key factor to clarify the value and function of the administrative law. In this thesis, a scientific orientated method was used for distinguishing the theoretical foundation of the administrative law science.To this end, a "three dimensional orientation method" was employed. That was to say, the theoretical foundation of the administrative law was oriented by the connection between itself and three dimensions, i.e., economic, politics and idealistic condition. Based on this, the theoretical foundation of the administrative law science could be generalized as "Power Control-Balance Theory". In addition, from the aspect of the essence and rule of the administrative law, the administrative law could be defined as the traffic rule of the administrative power, which was founded on the relationship between individual interest and public interest. On the other hand, from the aspect of the value and function of the administrative law, it could be defined as the total of the law criterion, which balanced the individual interest and public interest by controlling the traffic rule of the administrative power.Therefore, the investigation topics in the present thesis included: the scientific distinguish and its research method of the theoretical foundation of the administrative law science; the category of balance and the definitionAbstractof control power; building up a model of the administrative law and the administrative law science by using "Power Control-Balance Theory".
