Class Nature Of Law Theory

Traditional jurisprudence insists on the character of law. That is the law has class nature. But in theory they can't make their statements consistent. The conception of class is the product of political struggle during special historical period. The pattern of dividing human being's history formation according class antagonism lacks scientific principal. But the law character declares publicly for the fair and just sense of value in the era of making laws. It reflects the requirement of social main stream of ideology on the kind order. The class theory causes one-sided absolutism of social benefit analysis, and also causes the law to nihilism to spread. It negates the law's regularity and objection. Only when the narrow and naive class nature jurisprudence is got rid of, and the correct jurisprudence is s.et up, can China law ruling be carried forward.
