Sexual Crime, Social And Ethical Study

In this article,the author mainly analyze the crime of sex in the eye of ethics and morality.This article is divided into four sections .In first section, the author observes the regulation of sex in primitive society and considers that sex taboo and rule in a family circle in that period of primitive society isn't a real law and rule in essence but a combination of morality, religion and law. In the second part, by studying sexual regulation affected by state power and religion, the author point out that sexual regulation had been divided into two styles of morality and law. In the third section, the author asserts that with the development of industrial revolution, the social productivity had been rapid raised than before. The traditional rule of sex had been largely affected by changing society, and women's sexual consciousness began to be awake.By observing the historical evolution of sexual morality and sexual rule norm. The author gives some points: Firstly, the diversity of human beings' natural instincts, which is based on the sexual characteristic of human being, is the foundation on which sexual norm had been formed and evolved. Incest is a forbidden zone of human beings. Differences of sexual norm are initially derived from differences of physicality of man and woman. Great changes in sexual normal after the revolution of industry have been showing that women have been themselves in sexual instinct. Secondly, material condition of living took a great effect in the evolution, with the emergence of private system, It was the unevenness in material wealth owned by man and woman that it lead to the irrational expansion in sexual requirement of man. On the contrary, the sexual behavior and sexual mentality of women have been gotten into recession and oppression.Finally, Power constructs spirit of human beings and confines the idea of people. It is power that In last section, author analyze and criticize law of sex in our country and criticize moral tendency ofsexual rule .at the same time, author claim that the way to rationality of law will be much more longer for us. The author thinks that law should focus on the social relationship relevant to material benefits. Without mingle it with factors of morality and feeling. Nowadays, different kinds of moral standard and value sense are mixed up together with confliction. Law should hold an unconventional attitude. In this way, it can be succinct and powerful.
