China's Anti-monopoly Legislation

Competition is the soul of market economy. It is the common modus operandi for all countries in the world to insure the market economy body equal, fair, free competition by means of law. The anti-monopoly law, as the kernel of economic law has a great significance in maintaining market new order and promoting the economy developed stably and healthily.In addition to having the general function of maintenance of free competition and public interests, anti-monopoly law still plays a special action in perfect the economic and market structure.In this article, a comprehensive reach are studied on basic matter of anti-monopoly law system. By evaluating and introduction of anti-monopoly legal system and policy in western countries such as American, Japanese, Germany and Western-Europe countries, and using western popular viewpoint of government regulation and anti-monopoly economics as reference, the author have a in-depth discussion on the objective established on anti-monopoly legislation and construction of fundamental law system in China. According to the situation of our country and economic development, the legislation principle in China should insist on efficiency principle, aiming at protection and promote the effective competition, construction of the socialism market new order, boosting the stable and healthy development of economic society. The author of this thesis thinks that we can constitute an anti-monopoly law catholicity in general and severity in part, which not only can prevent the market malfunction but also government malfunction.
