Spouse Right In The Legislation Of The Study

The Marriage Law of P.R.C verified in 2001 established the "Principle of Loyalty". However the contents on the marital consortium under this principle have not been definite which causes many obstacles during the process of practicing the "Principle of Loyalty". Compared with the examples of legislations, the thesis discussed the conformity function of morality norm and law norm on adjusting the relation of marriage and family, based on analysis of the character of marriage charter, probes into the important value and necessarily of current legislation on the marital consortium in our country. The thesis paid attentions to the concept and characteristics of marital consortium, duty of loyalty, duty of co-habitant and the right of bearing etc. and discussed the above-mentioned contents in details, then raised suggestions on legislation combining the situations of different territories.
