At present the target mode of institution of labor dispute disposition has not been established in our country, it is concentrated on the problems of selecting the institutions of labor dispute disposition, selecting the types of labor judicial institute and the execution of three parties mechanism during the disposition of labor dispute. Starting from the practices the thesis analyzed the causes of labor dispute and the abuses of the current institution of labor dispute disposition in our country and discussed the advantages and shortcomings of several domestic theories on institution of labor dispute disposition existing in our country currently. Based on the abovementioned facts the thesis suggested that the domestic institution of labor dispute disposition should be established as "either by trying or by arbitration, self-selection to try or arbitrate, try once and arbitrate once, terminated by trying twice". Also it suggested that the labor judicial institutes should be no independent style with special trying, the bench of judges on labor dispute should be set up in people's court, the three parties mechanism during the disposition of labor dispute should be set up and completed and all these measures should be carried out comprehensively on organization, personnel and allocation of rights and so on.
