Insurance Fraud And Its Prevention

This paper first explains the cause of formation about the crime of fraud while the comparison of legislation on this crime between the common law and the civil law is made. Then requisites to constitute this crime is analysed while we discussed the controversy on this subject. This paper also includes the following parts: judicial maintenance, usage of the criminal law, proof collection and investigation, and how to be on guard on this crime.Insurance business is quite new in China with increasing of the crime of fraud. So there is a need to get to know the problem. This paper is written to make a comprehensive study on this crime.
