On The Chattel Mortgage System And The Trade-offs With A Security System

In this article,the author points out ,through analyzing the historical conditions of the chattel mortgage system and security transfers system,that they meet the demands of financing and therefore should be preserved.Now that the above two system have the same function,we should adopt one system.the author also points out the exsisting barriers to instruct the above two systems into the scheme of civil law,focusing on the difficulities of codifying the security transfers.Comparison is also made of the chattel mortgage system and security transfers system concerning exercising the same function.Based on the above comparison,the conclusion is made that we should give up the effort of regulating security transfers in our civil code and make great efforts to improve the exsited system of the chattel mortgage.Besides,the author presents us in this article what the chattel mortgage system is to become of in the futhur and,how to improve it .
