Study Of The Legal System Of Financial Supervision

Experiencing successive 15-year negotiation,China became a formal member of WTO on Dec. 11,2001.From then on ,the opening of Chinese finance is ruled by a timetable with acceleration.How should the Chinese financial supervisor alter their ideas and principles on constructing perfect and advanced supervisal system?The paper is for the purpose of analyzing the defects lying in the Chinese supervisal law and regulations,studying from experiences and lessons of other countries' reformation ,and proposing some preliminary views and suggestions on consummating the law system of Chinese financial supervision.The paper consists of four parts except preface and conclusion:In the first part, I make the limits of the concept "financial supervision" and indicate clearly that I will take the banking industry supervision as the center. Then elaborate in turn the three main goals of financial supervision; the main legal system (including preventive supervision legal system and crisis help legal system) in western nations ;the required conditions on effective supervision, as well as the new tendency in the area of international financial supervision .In the second part,analyzing defections lying in the Chinese financial supervising law system:simple-business and the corresponding supervision do not fit for the new development of world finance;the lag of inner control and property rights system;the ignorance of supervision principle by government ;the insufficiency environment of supervision by society ,ect.,.In the third part, studying reformation and changing of international financial supervisal system : First I elaborate vicissitude and recent development of the Basel Capital Accord , analyze all sorts of influences on bank supervisal law system ;then analyze advantages and disadvantages of the reformation in U.K. and U.S.A as two typical models respectively.In the fourth part, according to the comparison research before,I propose some preliminary views and suggestions on consummating the law system of Chinese financial supervision, establishing law system to the financial holding company's supervision, strengthening legislation of...
