Sino-japanese Legal Modernization

This thesis take the Chinese and Japanese legal system modernization beginning as the comparison object, elaborates their same background, including three aspects: the sharp contradiction between social politics, economic development and traditional legal system, western imperialist powers combining threats with inducements, western law culture large-scale dissemination; reviews the development courses and make the appraisal separately; analyzed the difference in Chinese and Japanese legal system modernization, including economic basis, legislation goal, main body of reform, attitude toward western culture and appraisal, degree of legal education development and personnel training situation, etc.; summarizes the experience and enlightenment with modernized legal system of Japan, such as to grasp the assimilation of national law, regard introduction of the law science theory as the guide, treat the cultural conflict by the strategic judgment, economic basis and political guarantee, establish modernization of the consciousness governed by law, adopting a correct attitude toward outside legal culture, absorbing outstanding legal culture in the world, spiritual cultural construction of strengthening the law, etc.; on the basis of the above, this thesis proposes the thinking that the contemporary Chinese legal system is modernized and draws the corresponding conclusion.
