This thesis take the Chinese and Japanese legal system modernization beginning in the last ten years of Mongolia's Qing government as the comparison object, elaborates their same background, including three aspects: the sharp contradiction between social politics and traditional legal system, western imperialist powers combining threats with inducements, western law culture large-scale dissemination; reviews the development courses and make the appraisal separately; analyzed the difference in Chinese and Japanese legal system modernization, summarizes the experience and enlightenment with modernized legal system of Japan, we find that transplantation of laws is very essentials.On the basis of the above, this thesis proposes the thinking that the contemporary Chinese legal system is modernized and draws the corresponding conclusion about transplanting laws.
