Contract fraud was first defined in 1997's version Criminal Law of People's Republic of China, and now is a familiar crime during the present law enforcement practice. According to the statistics furnished by economic investigating agencies of the police, the amount of contract fraud cases was above all other economic crimes in last few years. The author plans to further the study and discussion of this crime theoretically and pragmatically, so that we can systematically master the composition and characteristics of this crime, precisely distinguish the guilty from the innocent, efficiently and toughly crack down this kind of crime, and effectively prevent the crime.This dissertation begins with the necessity of setup such entry of crime through the features and harms of contract fraud, and the description of the present situation and main features of the crime in the law enforcement. Then this article analyzes the four crime compositions of the contract fraud, and clarifies the issues that can easily cause dispute. Next several crucial problems,which should be give special attention in the crime identification, are discussed. And a line is drawn between contract fraud crime and other offenses such as contract dispute, civil fraud, and other crimes related with fraud. In the end part, this paper discusses the measures of punishment and prevent of the contract fraud crime. And the emphasis is discussion on how to strengthen the work of investigation and collecting evidence by the police to improve the efficiency of dealing with such crime, so that criminal punishment can effectuate its prevent mechanism.This thesis systematically analyzes and discusses the identification, punishment and prevention of contract fraud crime, so as to clearly resolve those problems and disputes confronted by public security agencies. This article is written out of the hope that it can be of any use guiding public security agencies to crack down contract fraud crime.
