Infrastructure Asset Securitization Legal Issues In The Development Of The West

Asset Securitization has developed very fast since it came out from U.S.A in 1970s.Today the kinds of asset securitization are many and various, the income of infrastructure is a new sort of securitization.To improve the condition of infrastructure is a major task of western development, the asset securitization of infrastructure's income will help to make it. This article try to study the legal system of the asset securitization of infrastructure and put forward some proposals.The first chapter of this study generally introduced asset securitization ,include the definition and the general legal matters of it.The second chapter argued some general matters of securitization of infrastructure' income, and concluded it's possibility in the background of western development.Then the third chapter is the important of this article. All the study are centre round the securitization of infrastructure' income. It examined the legal requirement of the SPV, analysed the ways of asset transfer and other legal matters of securitization, and emphasized that the practical use of securitization in our country should be based on the existing conditions.The forth chapter brought up some solutions to securitization of infrastructure's income.
