The widely existing employment discrimination has seriously infringed the employees' rights and other interrelated rights of employees, and it also impaired the equality principle embodied in the constitution and other laws, disturbed the orderly implement of the labor market and effected the improvement of socialist market economics system. Therefore the study on employment discrimination should be stressed to find a workable measure. And this paper sets to discuss the problem by analyzing the current employment discrimination, the necessity and legislation on fighting such discrimination.In the first part's analysis on current Chinese employment discrimination, the reasons of discrimination in gender, census register, political status, age, height, outlooking and health get analyzed alternatively to point out the perniciousness of such discrimination.The second part is about the necessity of fighting employment discrimination. The importance of fighting against employment discrimination and protecting the legal rights of the employees has been proved by the analysis on employees' rights, the limited authority of the employers in choosing employees, the subordinate status of the employees, the requirement for establishing a labor market conforming to market economics system and the difficulty in getting a job.The third part is about the recommendation on Chinese legislation against the employment discrimination. The author firstly introduces the internal and external legislations against such discrimination and the defects existing in such legislation in China. And based on the introduction, the author advises the improvement of Chinese legislation against the employment discrimination.
