A bank is a corporate body with financing as its main business scope and profit-earning as its purpose. Thanks to the development of direct finance along with increasing trend of mix operation, overseas traditional banking business is confronted with narrowing of interest rate spreads and sharp competition within and outside of the trade. As a result of that, the bank's mismanagement and bankruptcy is inevitable. On the one hand, to wind up the banks suffering from mismanagement plays a positive role in improving management competence and strengthen the competitiveness of the banking trade as a whole; on the other hand, the bank serves as the core of debit and credit and capital transfer, thus is extremely important in promoting economic development, maintaining payment and settlement of capital and supporting social stability. In view of that, both overseas government and monitoring body take a considerably cautious attitude towards bankruptcy of the bank.This thesis, starting with the differences lying in bankruptcy between the bank and the ordinary enterprises, makes a comparative analysis on the bankruptcy system of banks of domestic commercial banks, banks of England and America and other countries, on the basis of the foregoing discussion, the thesis in its final part forward some suggestions on how to perfect bankruptcy institution of commercial banks in our country.
