With the reform of the housing system and the development of the commodity economy, the real estate management, as a kind of new model of real property, having been become the flourish developing trade at present Owners entrust the professional building management company with real property and establish the owner's congress, the Owner's Committee to perform the supervisory power, which has become the first choice of today modem residential space. As the autonomous organization of defending owner's rights, the Owner's Committee plays an important and decisive role in the real estate management Because the real estate management began relatively late in our country, and legal provisions concerned isn't perfect, and the democracy, legal consciousness of the whole society have the limitations, the system of the Owner's Committee is immature and society contradictory occasionally take place. This situation affects the development of the real estate management in a certain degree, especially the legal quality of the Owner's Committee isn't clear and the lack of restricted rules in the fact working. In the base of the important of the Owner' Committee and several problems in practice, the thesis will research the Owner's Committee. To analyses the work situation of the Owner's Committee, it will contribute to understand the market of the real estate management, and find the crucial reasons which restrict the development of the real estate management Thus, our national real estate management will develop quickly and soundly.The thesis comprises three parts. The first part will introduce the concept and traits of the Owner's Committee and several close, but easily obscure, concepts about it and so on. in order to discuss deeply the legal quality and concrete work of the Owner's Committee, the part will reveal the present existed problems about the Owner's Committee, too. The second part will mainly discuss the problems of the legal quality of the Owner's Committee. The obscure legal quality of the Owner Committee limits the development of the Owner's Committee. In theory, theOwner's Committee hasn't independent properties, so it couldn't independently take on legal responsibilities, and doesn't possess legal personal status, and doesn't accord with other organizations' condition which civil procedure act has provided. In practice, clearance of legal quality of the Owner's Committee could determine whether it could independently be engaged in other civil exercise except for signing civil contracts, and whether possess independently lawsuit status, and whether independently take on law responsibilities. However, our national laws and regulations don't clearly provide for it, which results in the situation that differs in judgement. On the base of the first part, the part will make further discuss the law quality of the Owner's Committee and determine the Owner's Committee site in law. The thesis raises an opinion that the Owner's Committee and the residential committee should be merged by stages. This will solve the problem of the independent status for the residential autonomous organization. The third part will discuss the concrete work system of the Owner's Committee. Today, laws and regulations concerned are principle or aren't regulate. However, detailed regulations of the system will safeguard successfully the Owner's Committee to work and keep own rights. Aimed at the exited concrete problems at the moment, this part will discuss the work syst(?)n of the Owner's Committee and give the feasible project.The Owner's Committee is a newly object The emergence and work of it will affect greatly the real estate management The successful work of the Owner's Committee will certainly enhance the ability to participate in and manage own affects through democracy for people.
