With the general economic background of globalization, multinational companies' operation and competition behavior have already been beyond the domestic market to the whole global market. Besides the quality and price technology ,as the company's critical resources in knowledge economy ,are becoming another competitive focus ,so Intellectual property which is the unique meaningful existence form of company's technological innovation is not only the subject matter of international technology trade and legal right but also the vigorous approaches for multinational companies to defeat rivals and win the market competition .It is the new form for multinationals to anticipate the market competition under the regulation from international economic rules like WTO arrangement by establishing the special organ and regulations to analyze the intellectual property's nature, authority, appliance, license, distribution and competitive situation of one's own technology and domestic or abroad similarities formulating and using the intellectual property strategy ,for instance, patent strategy and managing the company's patent resources through professional managerial system.Due to being more powerful and starting operating abroad, in particular, the entrance into WTO, Chinese companies are meeting with more and more complicated patent disputes. From the issue of DVD patent fee, the following patent dispute about digital camera, high-energy battery and electric razor to the CISCO & HuaWei patent infringement case which had a huge impact on the whole IT world, more and more our companies start to face the challenge of patent charge from multinational companies about infringing upon their patent rights, patent strategy has been a new weapon for multinational companies to fight against the component in the global business world. They are taking advantages of their scientific patent regulations, strategy analysis and strategy usage as well as theleading status of international rules arrangement to strive for market share, maintain the status of monopoly and set up trade barrier. As the patent strategy regarded, our companies are weaker in the marketing competition than the multinational companies and it has affected the development of our companies, some even has strengthen existence of our companies. So it is essential to study the patent strategy to protect us from the attack from multinational companies and try to be positive in the international economy. That's why this paper exists, meanwhile the paper tries to analyze patent from angle of marketing competition and international trade not angle of law, so it relates patent study with the content of marketing competition and international trade. That is what the paper's innovation lies in.After introducing some basic concepts of patent strategy in chapter one, the behavior, original reasons, substance and impact on our companies of multinational companies' patent strategy usage is systematically analyzed in chapter two. By studying the typical cases to follow closely the development of multinational companies' patent strategy and paying much attention to the new trend in international trade, especially the field related to patent, chapter three tells us the new phenomenon of patent strategy usage and the potential affect which the new round TRIPS negotiation may arise. The comparison, which makes us have a clear idea about our levels of using patent strategy, consists of chapter four. At last in chapter five from entrepreneurial and governmental levels bringing up with some proposals in order to strengthen our companies' ability of using patent usage, avoid the patent attack and patent barrier and get the leading roles of marketing competition back.
