Form clause rise shortly one hundred years ago, and has been watched closely and widely for its wide use and close connection with consumers' benefits. What our country studies about the form clause starts relatively late, and because of the influence from the traditional system, our country is problematic on the clause system of the form , therefore there is a realistic meaning particularly in the study on form clause. Starting with analysing the form clause characteristics .this text think that form clauses are drafted in advance for concluding a treaty with relative people .but not specific ones ,and are not allowed to be consulted while concluding a treaty . Then, this text has expounded the fact that carries on the necessity of the structure and theoretical foundation to the form clause , having analysed its four kinds of ways to carry on structure, namely legislative structure , judicial structure , administrative structure and social structure. Our country has legislative loopholes in the structure of the form clause more; the administration of justice is confused ; the administrative structure performs practically no function. In order to perfect the structure to the form clause, four suggestions of this text are proposed: 1.Make the special law; 2.Improve the competence of judging , and introduce group's lawsuit; 3. Strengthen the functions and powers of administrative department of industry and commerce, restrain administrative authority of the trade ; 4.Establish the system of social supervision.
