On The Main Body Of The Crime Of Corruption

The subject of the crime of embezzlement is one of the fundamental elements to constitute of embezzlement. The theoretical community of criminology in China divides the subject of the crime of embezzlement into two categories, namely, general subject and special subject. This thesis, through retrospection of the stipulations relevant to the subject of the crime of embezzlement of our country, points out the problems existing in the stipulations relevant to the subject of the crime of embezzlement and analyzes these problems from the perspective of history, cultural tradition, politics and economy. This article emphatically elucidates the relevant regulations of the special subject of the crime of embezzlement, points out that some of these stipulations have contravened such basic principles as "crime and punishment shall be stipulated by law" and "crime and punishment shall strike a balance" and comes up with some specific legislative suggestions.
