The crime of producing and selling false medicines is the object of study in the thesis. Beginning with the evolution of the legislation about the crime, the author emphatically probes into some matters concerned, for example, the characteristics of constitution, the judicial determination and the application of criminal law, and so on .In view of the shortcomings of the legal regulation and the theory of law, the author carries on discussion and analysis and inquired to some degree. Meanwhile, the self-viewpoint of the author is put forward, which is hoped to be beneficial to the study of the crime.The thesis is composed of four sections:For the first section, by quoting some examples of case, the author briefly recount the necessity of perfecting the legislation of the crime and the process of it.For the second section, the author comparatively analyse all kinds of expression ways and views about the concept and the characteristics of constitution of the crime.For the third section, the author discusses the knotty problems occurring in the judicial determination and the application of criminal responsibility of the medical establishment which uses false medicines.For the fourth section, the author concludes the views which disperse in the thesis, and thus, draws three conclusions.
