On Administrative Compensation

Simultaneously, administrative compensations almost involve administrative subject's legal violations. Because of these factors, administrative compensation is disvalued in the theoretical field. But in realistic circumstances, whether administrative compensation is institutional or not, it has much to do with the matter that citizens can have their legal rights reasonably and efficiently protected.In this essay, author will first brief about general theories of administrative compensation. In other words, I'd make a research on the concept, theoretical foundation , nature and elements. So it is necessary for us to build up the theoretical foundation of administrative compensation. Based on that, analysis is made on the fundamental contents of administrative compensation. That is to say, a discussion is undergone on the basic principle, types, scope, legal procedure and relief mode etc. Then, the basic frame construction of administrative compensation system is established. Finally, combining the above-mentioned theoretical foundation and the fundamental contents, an in-depth dissection is done on the related system of administrative compensation in the present conditions of our country. To establish efficient administrative compensation system in China, it is a must to give a definition of the fundamental principles in Constitution Law. At the same time, it is of great necessity to improve the scope and criterion of administrative compensation, to find effective legal procedure and relief ways of law, to enrich the ways of assumption and sources of expense in basis law and separate acts.
