Study Of Network Links To Intellectual Property Issues

This dissertation gives an account of the intellectual property protection based on network linking. The author points out some difference in respect of international and national intellectual property law. At the same time, the article illustrates basic problem of network linking. In this article torts of deep linking are research emphasis. This article analyses one by one copyright and trademark right and unfair competition relate to deep linking. Detailed discussions are made in respect of the relation between deep-linking and copyright. In the article quotes international and national present typical cases are quoted to attempt to reveal legal dispute of network linking under different legal environment and correlative laws and regulations. Then the author brings forward some shallow suggestions. Finally, the dissertation brings forward some suggestions of perfecting correlative laws and regulations based on present situation of national network intellectual property and legislative experience in other countries. And the article puts forward some suggestions how to keep a lookout on intellectual property dispute of linking in order to provide some assistances for party concerned.
