Folk Literary And Artistic Works Of Intellectual Property Protection

Folk literature is "traditional knowledge" and " oral and nonmaterial heritage", the international laws make explicit regulations about appraising, spreading and protecting folk literature. In China, it is urgent to protect the expressions of folklore. It has been concerned by people including its definition, special characters and projected objects, etc. The paper gives concrete illustrations on the above aspect and brings forward the assumption to establish a system based on the intellectual property protecting.Following a review of concepts and features of the folklore in chapter one, the actuality and general issues regarding protection of folklore over world are introduced, respectively in chapter two and chapter three.Using intellectual protection system to protect folklores, this paper concentrating on, in our country is studied. The theme is discussed in three parts, which are main problems of protecting folklores in terms of copyrights, measures having taken in our country and a way to establish a protecting system based on the intellectual property protection.
