Copyright Protection Of Folk Oral Literature

Intangible cultural heritage is one important part of our social civilization. It is the foundation of the cultural diversity and the development of the society. As a branch of the intangible cultural heritage, folk oral literature is important to the development of the culture and the literature. Folk oral literature’s great spiritual values and economic value have been widely accepted by countries all over the world, and most countries have legislated to protect and develop the folk oral literature. According the character of folk oral literature, there are several protected models. After a feasibility study on folk oral literature’s copyright protection and a comparative research on protect models, the author believe it is a better way to choose the copyright model to protect folk oral literature.This paper has six parts. The first chapter distinguishes several words which are interrelated with folk oral literature so as to define folk oral literature. And then the characteristics of folk oral literature are presented, including the multidimensional forms of expression, the uncertainty of the creation, the continuity of the creative work, and the inheritance in the variation. The second chapter is a study in legislative practice on folk oral literature some countries and imitational originations. The third chapter is to prove the advantages of copyright model, prior to which the paper presents the folk oral literature can be copyrighted. The forth chapter analyzes the object of folk oral literature’s copyright protection. The fifth chapter discusses the subject of copyrights. The Copyright Law has its restraint and the last chapter investigates the copyright restraint of folk oral literature.
