Drawing upon the rich literature on the crime of robbery in china and abroad, this paper analyses what constitutes the targets of the robbery, and how to establish aggravating circumstances and what may be non-typical robberies. This paper has three parts:Ⅰ, What about constitutes the targets of robbery. This part analyses whether interests in property, real estates, and illegal property constitute the targets of robbery, the author argues that interests in property and illegal property may constitute targets of the crime while estate itself is not the target. However cases involving dispossession of others' real estate by force should be treated as robbery.Ⅱ , How to establish aggravating circumstances . As a result of the major amendments to the 1979 criminal law, the 1997 criminal law has become more operable, but controvercial issues do exist in implementation, the author will be analyses some of these issues, and also have some own opinions in this essay.Ⅲ, What are non-typical robberies. In this essay the author considers the following as non-typical robberies and makes analysis of each category; in the criminal law the Article 267 (2) provided armed snatching, and according to the Article 269 provided that cases shall be convicted and punished as robberies, and heads of assembling a crowd for beating, smashing and looting.
