On April 4th of 2002, "Ordinance on Handling Medical Malpractice" was issued by the State Council. Compared with "Measures for Handling of Medical Accidents", the Ordinance has expanded the connotation of the medical malpractice, defined the civil liability that the medical malpractice infringes, enlarged the compensation of the medical malpractice, all of which balance the relationship between doctors and patients. Nevertheless, many deficiencies have been found since the Ordinance got implemented over two years ago. Some part of the content of the Ordinance is not in accordance with relative national laws. And patients' legislative rights and interests don't get complete protection. Furthermore, the fairness of the technical appraisal for medical malpractice is still questionable. Therefore, aiming at the existing deficiencies of the Ordinance and associating the current status of the doctor-patient relationship , some moral suggestions are given in this article to improve and implement the Ordinance intending to further regulate the markets of medical services, safeguard the legislative rights for both doctors and patients, promote the development of the medical science and technology, form the harmonious doctor-patient relationship and finally make high-qualith services provided for the patients.
