On The Right Of Folklore To Be Protected

The folklore is a part of the traditional knowledge, it is more and more used by business, but the source of the folk art is often placed in the place which economy is falling behind , information is stopped up. A lot of folklores have the worth of history and art, facing the lost dangerous situation, so the protection of the folklore is very important. At present, WIPO is positively pushing protection of all countries folklores knowledge property right .Up to now, our country have not start to protect the copyright of folklore. This paper draws lawmaking from the international and other countries, in the base of analyzing protecting necessity of folklore copyright, according to the basic theories that put forward the way of the protection of our country s folklore copyright. We hope that our country can establish the copyright protection system of folklore as soon as possible, developing the traditional folklore reasonable. This paper is divided into the four parts: Part one: define the meaning characteristic of the folklore; Part two: introduce the lawmaking protection of international and our country s lawmaking present condition of folklore; Part three: study the necessity of protection and the difficulty of copyright of the literature art, point out to establish the special copyright protection rules, it is shouldaccording to classification of folklore;Part four: set up the copyright protection system of thefolklore about our country, study the problems of the lawmakingaim, right corpus, protect scope, right contents etc...
