Government Credit Legal Protection Of The Study

Market economy is a credit economy and government credit is the core and base of the social credit system. In today's China, it has been a big hamper of lacking social credit for the development of market economy. With the further development of our socialist "rule of law", especially after China entering into WTO, the need of taking part in the international competition has made it a urgent task for us to rebuild government credit and set up unified perfect legal security system of government credit to fit in with the socialist market economy system.Applying the ways of comparison and value analysis,on the basis of using and reading the system of Britain,America,Germany and Japan for reference,combing with the concrete conditions of our country,this paper gives the following suggestions on how to improve and perfect the legal security system of government credit in our country:Firstly,our country should establish freedom of government information system and enact a comprehensive freedom of government information system law which should give specific and explicit provisions of the principles,scope,ways, procedure and legal liabilities of the freedom of government information.Secondly,our country should establish systems of administrative procedure and enact the administrative procedure law in which it should be concrete and explicit provisions of the basic systems such as investigation system,hearing system and challenge system as well as mode of objective,selection of value and legal liability of the administrative procedure law.Thirdly,our country should establish system of legitimate expectation and give provisions for the legitimate standard,unprotectively expected standard,compensation protection and compensation conditions limited strictly.At last,our country should perfect system of remedy and supervise,strength and supervise the construction of laws and regulations,set up special supervisory organizations of government creditand perfect the systems of administrative appeal, adminstrative review and administrative compensation.
