China And South Korea's Foreign Investment Law And Its Associated Regime Is A Comparative Study

As international production and world-wide strategy of multinational corporations becomes more extended and deepened, it has caused massive turning point in economy world-wide, and international investment has become one of the major activity in world economy. At themoment, reinforcement of dependence and subsidiary between nationsis taking place, and every developed and developing country is seeking domestic economic development through introduction of foreign capital. However, social and economic status is differed, economic basis, economic structure are also not the same in every nations. Therefore, foreign investment and its relevant system are also differed in different countries. Law of foreign capital in Korea and China can be recognized in same manner;attracting foreign capital played importantrole in achieving steady and stable economy in the two countries, not to mention foreign investment is a key point at domestic economicgrowth. Recently, direct investment is increasing fast in two countries. According to organization of foreign economy and trading of China, Korea's accumulated invested items to China until 2005 Sept. are up to 31,742 and the investing amount is up to 2,550 million dollars,and this implies Korea has become one of the major sources. Investment of Chinese corporations to Korea is also increasing at present.According to Korean Ministry of Commerce, Industry and Energy, China's accumulated invested items in Korea until 2005 Sept. are up to4,693 items in Korea and its amount is up to 173.4 million dollars.However, two nations have different opinions towards foreign investment law and its relevant system, and have different issues on law system of foreign capital and foreign capital system. I, as a Korean student studying international law in China, would like to compare andanalyze comprehensively about foreign investment legislation of two countries, capital system of foreign investment corporations, legal treatment and privileges system for foreign investor, legal protection for foreign investor in Korea and China.
