State-owned Enterprises In The States And Their Property On Jurisdictional Immunities Of Research

With communication of international civil and commercial affairs increasingtoday, there are more and more problems on jurisdictional immunity of the state andproperty. Owning to the difference both in theory and practice in differentcountries , there is divergence about this issue. Convention on JurisdictionalImmunities of States and Their Property was adopted by the General Assembly in2004.Thereinto the relationship between the state and their enterprises has been one ofthe most favorable issue. This issue is also well involved with the status quo of ourcountry. This article tells relations of the state and enterprise in the system ofjurisdictional immunity of the state and its property and what standpoint do ourcountry should take. From the present situation of our enterprises, the article analyzesthe reasons, which are rights of separating results that enterprises have no realindependent law personality. At last, it provides the measures we should take.
