Study Of Tibet's Ecological Environment And Natural Resources Protection Legislation

This article consists of six parts.In the leading part of the article, the author gives brief introduction of purpose ofthis article and its study scope, comments on the current situation of Tibetanenvironmental legislation and then gives explanation to the theoretical and practicalbasis of Tibetan environmental legislation.The second part first clearly defines the concept of "legislation of Tibetanecological environment and natural resources protection", then commences itsthorough exposition of the objective background of Tibetan environmental legislationfrom four aspects: natural geography, traditional culture, politics and social economyas well.The third part mainly deals with the necessity and importance of strengthening ofTibetan environmental legislation. The fourth part gives detailed explanation to thecurrent situation and existing problems of Tibetan environmental legislation.The fifth part is the key part of this article. The author puts emphasis on theenvironmental ethics, the leading idea, the basic principles, which should beascertained in Tibetan environmental legislation and detailed settlement methods tothe existing problems. In the author's opinion, Tibetan environmental legislationshould be constructed on the basis of the "ecological-interest-centered" ethics alongwith its steady compliance of the leading idea of sustainable development as well asscientific legislative principles. In detailed practice, scientific legislative plan shouldbe made in accordance with the local condition, legislative transparency should bestrengthened to increase the ability of public participation, systematic innovationshould be paid much attention to so as to further perfect the contents of Tibetanenvironmental legislation. Besides, the systematic construction thereof and thelegislative technology should be improved and in the meantime,The last part of this article is the conclusion of the main points. The author pointsout that Tibetan environmental legislation should be carried out on the basis of thesettlement of current problems, cast off human-centered environmental ethics whichfocuses on the economic development, stick to the leading idea of sustainabledevelopment, advance along the road of harmonious development between humanand nature, social economic development and ecological environmental protection.
