Civil Preservation System Analysis

This dissertation includes six chapters, the main content andopinion of each chapter is discussed as follow:Chapter 1: General analysis of Civil SecuringThis part firstly clears up the system in the main countries(district) and confines the concept.Secondly,this chapter probesthe quality,destination,value and function.The destination of theCivil Securing judgment process is providing the safeguard to theparties.The value of the process is coordination in the process safeguardand process facilitation and prompt.Chapter 2: The Target of Civil SecuringThis chapter discusses the object,the measure ,the type ,thetarget of Civil Securing according the 'Germany System'.On the basisof the difference of the target,It can be divided to three type:MeasureSecuring , Person Securing , Behavior Securing . At last , It isdiscussed of the type of the Civil Securing in China.Chapter 3: The Process to start up the Civil SecuringFirst,this chapter discusses the parties of the suit is the only bodyto start up the process .Second,This chapter probes the essentialconditions of the Civil Securing application and put forward thatguarantee is not the condition of this application . Basing on thedestination of the Civil Securing process,It should be do to perfect andenrich the reasons to this application through absorbing the modus of thecase law system.Chapter 4: The Process to judge the Civil SecuringAfter reviewing the alike process in main countries and districts,the author consider that the construct this process should be in guide ofthe value of the Civil Securing process.Firstly,It should be decided toadopt the confrontational or unilateral hearing regarding to the casesituation and the measure of the securing;Secondly,simplifying theprocess to judge.At last ,this part discuss the issue on 'ruling orjudge?' .Chapter 5: The Process to remedy involved in the Civil SecuringReviewing the alike process in main countries and districts,Theyare ingenious and provide sufficient safeguard to the parties.So theauthor try to design this process ,that is missing, in China .Chapter 6: The Execution of the Civil Securing judgmentThis chapter discuss the startup of the execution and the body whoexecute the judgment.To sure the prompt value of the whole process,the execution should be start up as soon as the judgment is issued.Andthe author discusses the body to execute the Securing measure should bethe judicatory executing institution .
