The Reconstruction Of Our Natural Resource Rights System

The PRC law regulates that the natural resources property belong to the nation and collectivities. That accredits the nation of all the natural resources rights indeed, and deprives of local government and collectivities' right of benefiting from the natural resources to maintain living, which is their inherent right. In allusion to the various problems such as illogical and ambiguous natural resources right system, low efficiency distribution system, irrational local economic structure, unsustainable development, environment pollution, etc, this article abstracts the essence of the problems as the property system, puts the emphases on the analysis of the three main body's interest, discusses what's their property state and what they should be, therefore divides the natural resources property system into three most typical kinds: mines, lands, and environmental compensation between territories to facilitate the analyse.The kernel of this article is the reasoning of the local people's right to benefit from the natural resources, and the due distribution system which is crucial to the harmony community according to the temporal conditions, by comparing and research on the natural resources rights, the nation property, the collectivity property, and the law against the inherent rights.
