Contractual Right To Terminate Research

The contract rescission is an important law system of, as one civil right the right to rescind the contract comes to being with the contract rescission system. Commencing from the connotation of the right to rescind the contract, the paper investigates the legal practice, judicial cases and theory of the right to the contract about the continental law system and the Anglo-American law system; analyzes the characteristic, the construction and the worth target of the right to rescind the contract. In the paper, the author also analyzes the basic theory about the using condition and the effectiveness of the right to rescind the contract. At the same time, the paper takes the advanced practice of the continental law system for reference, combines the judicial practice under the market economy system, and hopes to open that the right to rescind to the contract is in the nuclear position in the contract rescission system. It puts forward some suggestion to improve of the contract rescission.
