The rules forbidding marriage are the primarily objects which are discussed in this paper. The paper goes with the development of Chinese history and researches this system systematically. First, the rules forbidding marriage are also called the hindrance to marriage or negative requirements. They refer to all the circumstances in which getting married is prohibited in the Marriage Law. The rules forbidding marriage contain the ones that prohibit the engagement and marriage (getting married and divorce) in broad sense. And they only contain the ones that prohibit getting married in narrow sense. The paper researches the system in narrow senseā€”to limit the object to the rules forbidding getting married.Every country has different rules to forbid the marriage, such as the prohibited degrees of relationship, prohibited diseases, prohibited relationship of custody, prohibited persons who commit adultery with each other, prohibited race, prohibited periods for the women who bereft of their spouses. Some of the rules are strict, and others are undemanding. Pursuant to the Marriage Law in our country, these persons who are blood relations in certain degrees or have certain diseases are prohibited from getting married. The development of the system of marriage is an indivisible part in the national culture in our country. The rules forbidding marriage have developed from obscuration to modernness and from wildness to civilization. At last, they become rational and scientific. Meanwhile, they show such characteristics: succession, variation, nationality and differing from other areas. At that time, a lot of functions of such rules have also been showed. The marriage system evolved in the form and developed in the ethic. And then, the legislation on marriage could be governed well.
