On The Humane Execution Of Punishment

Criminal execution law is one of three mainstay subjects in criminal jurisprudence system which parallels to criminal law and criminal procedure law. However, it is most easily ignored in practice. Prison is the executive department of punishment in our country. The execution of sentence of prison makes the punishment of crime transfer from the declaring state of judicial department to the reality state. Thus it finally finishes the complete operation of punishment from the normative state of legislation and initiation to the declaring state of judicial petition and uses, to the reality state of execution of sentence.Firstly in the article the author points out the existing problems in the process of executing punishment in present China by seeing about the execution of imprisonment for a definite period and life imprisonment, while analyzing the reasons leading to these problems from historical cultural tradition, political and economic aspects. Secondly, the author demonstrates the connotation of humanization of punishment execution. Finally, the author puts forwards some advice perfecting the humanization of punishment execution.
