Torts Protection

During the construction of the socialist harmonious society, it's of great special significance to study the protection of tort obligation, but the modern civil law system makes the tort obligation a disadvantageous station. This paper begins with the study of the definition and social function of tort obligation, puts forward the insufficiency of tort obligation through the history review of tort obligation, then, analyzes the effects that how liability insurance and social security replace the tort obligation, with the conclusion that the tort law is the foundation and can't be replaced, liability insurance should be first considered and social security is the last-ditch. Finally, the author brings forward some suggestion for the perfection of tort obligation from the aspect of civil law, insurance law, social security law and criminal law etc.
