Study Of A Number Of Issues In The Drug Smuggling

This thesis is divided into four parts:The first part is about the discussion on the crime object of narcotics smuggling offense. The object of the crime means the narcotics in the narrow sense, it refers to the narcotic and the spiritual drugs that have the anaesthesia nature and can cause people to form the drug addiction and the dependence if they suck for long time. At present the correlation legislation and the judicial interpretation of our country about the purity of narcotic that whether converts are contradictory. The legal provisions violate the principle of that crime and punishment is consistent and should carry on the purity conversion. The articles of related criminal laws should be revise as soon as possible.The second part is the analysis of criminal behavior of narcotics smuggling offense. Generally there are six ways of smuggling behavior, and the acts below should be considered as the offense of drugs smuggling: Transport, purchase or sale the drugs that are banned to import and export in the territorial sea or inland sea, and purchase drugs directly from the persons who smuggling. Identified drug traffic correctly needs to distinguish with the related acts such as transport, traffic, possession, mail and carry.The third part is the study of the patterns of narcotics smuggling offense. Judging accomplished offense and attempted crime should adopt the revised national standards, that normally the behavior of crossing the states (border) is accomplished offense.
