On The Improvement Of The Scope Of State Compensation

On 14^th, March, 2004, the constitutional amendment recorded "the state will respect and protect the human rights" in the constitution. Thus, the principle of protecting the basic human rights has been established a further step in the constitution. That establishment is extremely important for both further consummating national range of compensation, and adjusting the system of protecting the constitutional basic rights from the origin of national compensation. This essay begins from the system of civil basic rights, which is guided by the principle of protecting the basic human rights, discuss the relationship between the basic civil rights and the compensatory range of the national compensation law. And then, it discusses the basic state of the range of the national compensation, the present shortcomings in the compensatory range in the compensation law.Apart from the introduction, the whole essay includes three parts.The first part is mainly about the relationship between compulsory demand in the human rights protection and the further consummation of national compensatory range.From the discussion on the establishment of the principle of the basic human rights and the constitutional rule of civil basic rights, this part firstly focuses on the relationship between strengthening human rights protection and protecting civil basic rights. By explaining the elementary contents and range of the constitutional civil basic rights, it presents the relationship between the national compensation law and the constitution, further consummating the range of national compensation and protecting the civil basic rights. It suggests that the further consummation of the national compensatory range is the essential demand of strengthening the protection of human rights.
