The study in conception is a process of clarifying the nature of a certain thing, the same is true to the study in the conception of gambling, through which this particular social phenomenon will be reinterpreted and rediscovered. The purpose is to find out the essential characteristic of gambling, to grasp the nature of its conception, to distinguish it form entertainments, to end the current confusion in the conception of gambling, and to provide support in theory for scientific legislation and correct justice. In the past few years, there have not been many discussions on the legislation of gambling crime in the criminal law profession. Nevertheless, it does not necessarily mean gambling's inexistence, but it hasn't got enough attention. During the process of nationwide blow on gambling crime sponsored by national government in 2005, the lag of legislation on gambling crime became more and more apparent Still there are a lot of problems such as the identification of the place and capital concerned with network gambling, the blank of gambling crime legislation against the called "officials gambling " committed by state Functionaries. In practical justice, the demarcation between gambling crime and related crimes are always confused. I have made some comparisons and analyses on some of the most common gambling crime, and also briefly discussed the identification of gambling capital which is hard to deal with in practice, hoping to do good to the judiciary practice.The thesis has 5 parts expect for the preface.Part 1 has the legal conception of gambling through discussions on several definitions of gambling. That is, gambling is a type of illegal activity for the purpose of profit, with the stakes of money or objects, and judging winning or not by an agreed, event's occurrence and the way it occurs. The significance to give an accurate conception of gambling lies in better protection of the people and sterner punishment against crimes. It is also the need of building a democratic society.Part 2 is the reflection of out criminal law legislation on gambling crime.
