Wto Safeguards System Research

Under the framework of WTO, the provisions of safeguard measures refer to the permission by the agreement which allows its members temporarily betray its commitment or obligation in certain specific circumstances to relieve the impermanent difficulties or pressures caused by the implementation.Through a general overlook of the whole system of WTO, the provisions of safeguards mainly embody Article DD of GATT, Agreement on Safeguards, Article D of Agreement on Agriculture, Article D of Agreement on textiles and clothing, Article D of GATS and so on. All these provisions act as the "safety valve" and the exceptions of the whole WTO, which play a vital role in impulsing the liberalization of the global trade as well as in protecting the fair business environmentThe system of Safeguard measures under WTO is based on Article D D of GATT, and marked with Agreement on Safeguards. This thesis is an all-round analysis on WTO Safeguard measures.lt first introduces the basic theory of Safeguard measures and the formation of Safeguard measures under WTO.Then it concretely analyzes the condition and procedural rule to apply the safeguard measure under WTO by analyzing "the US-lamb", and also the settlement of such kind of cases.At present, China has already had a general system of Safeguard measures based on The People's Republic of China Safeguard Measures regulation and reached the requirement of the entry to WTO to some extentBut this system still has some shortcomings in details,so this thesis gives some suggestions on the stage and aim of the legislation of mis system,and also some suggestions on the substantial and procedural rules to better the system of the safeguard measures in China.
