Integration Of Intellectual Property Legal Protection

In the modern world, science and technology is developing rapidly. Particularly the so-called New Revolutionary Technology, with Information Technology as the leading force, including Micro-Electronic Technology, Bio-engineering Technology, New Material Technology, Aero Technology, is changing people's life and work. Among all influential technologies in this so-called Information Era, Micro-Electronic Technology is the most important, upfront and fundamental one. Integrated Electric Circuit Technology is right the core of Micro-Electronic Technology, and forms the basis for the modern Electronic and Information Technology. Since the second half of the 20's century, Integrated Electric Circuit Technology has not only been playing an important role in many countries' national economy and development, but also been highly related to many countries' core competitive power, and has become the status symbol of a country's combined industrial level in the world. So there is such a dissertation saying that the countries possessing Semi-Conduct Technology in future world will direct the whole world, as the OPEC has been doing now.Although our country has attached great importance to the Integrated Electronic Circuit Technology, we are still quite long behind the developed countries. With our entry of WTO and globalization of World economy, our country has realized the importance and compelling power of developing Integrated Electronic Circuit Industry and providing relative legal protection of intelligent property. That is, our country has to provide a good environment and space for Integrated Electric Circuit Industry, as a result, in 2000, National Affairs Council announced 《policies encouraging development of Software Industry and Integrated Electric Circuit Industry》. Afterwards, Beijing, Shanghai and other cities' local governments have made favorable policies and development plans to promote Integrated Electric Circuit Industry. However, policies alone are not enough, Integrated Electric Circuit Industry has to be protected by the laws of Intelligent Property. Because of its uniqueness and specialty, traditional Intelligent Property laws like Intelligent Property laws, Copyright laws, Trade Mark laws cannot provide appropriate or enough protection. Therefore, on Oct. 1, 2001, 《Stipulations for protection of Integrated Electric Circuit Design and Drafts》 were announced and enforced ever since, which is a symbol that our country has special laws to efficiently protect Integrated Electric Circuit Designs, Drafts and related Products.This paper is drafted from the above mentioned background.
