The standard contracts are the result of the modern economy and social progress. The progresses with fast speed bring up the standard contracts and make it being applied widely. With the fast development of society and economy, the growing inequality between consumers and big enterprises, between employees and employers compel us to think it carefully. The abuse about the Freedom of Contract strikes itself greatly and it makes us to consider it clearly. The limitations of the standard contracts result in the regulation about itself and remedy the unbalance which is the necessary result of the inequality between both sides. It is important that the limitations of the standard contracts safeguard the legal benefit of the consumer and employee, at the same time, it is also important to the social continuous stability and the economic fast development. That is the real reason I select it as the subject of my Master Degree dissertation.My dissertation is consists of five chapters. The first chapter discusses its conception, origin, character and legal character of the standard contracts. On the basis of the analyzing its advantages and disadvantages , the second chapter points out the necessary of controlling the standard contracts and its importance in safeguarding justice and impartiality. The third chapter analyzes the legislative regulation mode, judicial control mode, administrative regulation mode and social mode of foreign countries. The foreign countries have many invaluable experiences and we can benefit ourselves from them. Only through our comparative research to foreign countries can we correct the disadvantages of the regulatory modes of the standard contracts. The fourth chapter sums up the regulatory modes of my country, points out the shortage of our legal system and different viewpoints, and expounds my personal viewpoint.
